Роль законодавчої влади України в публічному управлінні в умовах воєнного стану

Abstract

Кваліфікаційну роботу присвячено визначенню ролі законодавчої влади України в публічному управлінні в умовах воєнного стану. У вступі обґрунтовано актуальність і рівень розробленості обраної теми; визначено мету й основні завдання, об’єкт, предмет та методи дослідження; описано наукову новизну; встановлено практичне значення одержаних результатів; зазначено структуру й обсяги роботи. На початку роботи розглянуто конституційно-правові засади законодавчої влади в Україні. Значна частина роботи присвячена визначенню місця законодавчої влади України в процесі здійснення публічного управління та аналізу її функціонування в умовах воєнного стану. Безпосередньо охарактеризовано функції законодавчої влади в аспекті формування і організації діяльності інших гілок влади; розкрито сутність воєнного стану та проаналізовано нормативно-правове регулювання організації роботи парламенту в умовах такого стану; узагальнено результати трирічної роботи Верховної Ради України та з’ясовано роль її нормативно-правових актів у здійсненні публічного управління в умовах воєнного стану. Наприкінці роботи запропоновано способи удосконалення організації і діяльності законодавчої влади України на сучасному етапі, враховуючі сучасні проблеми її функціонування та необхідність оптимізації роботи самого парламенту України, особливо, в умовах воєнного стану і після його скасування. The qualifying work is devoted to determining the role of the legislative power of Ukraine in public administration under martial law. In the introduction the relevance and level of theme development are substantiated; the purpose and main tasks, object, subject and methods of research are determined; the scientific novelty is describes; the practical value of the obtained results of master’s work is established; the structure and scope of work are indicated. At the beginning of the work, the constitutional and legal principles of the legislative power in Ukraine are considered. The main part of the research is devoted to determining the place of the legislative power of Ukraine in the process of public administration and analyzing its functioning under martial law. The functions of the legislative power in the aspect of forming and organizing the activities of other branches of government are characterized. The essence of the martial law is revealed and the legal regulation of the organization of the work of the parliament in the conditions of such a state is analyzed. The results of the three-year work of the Verkhovna Rada of Ukraine are summarized and the role of its normative legal acts in the implementation of public administration under martial law is clarified. At the end of the qualifying work, ways to improve the organization and activity of the legislative power of Ukraine at the current stage are proposed. The modern problems of the functioning of the parliament and the need to optimize its work are taken into account, especially in the conditions of martial law and after its abolition.
