Державне регулювання усиновлення як складової системи соціального захисту дітей

Abstract

Кваліфікаційну роботу присвячено дослідженню державного регулювання усиновлення як складової системи соціального захисту дітей в Україні. У вступі обґрунтовано актуальність і рівень розробленості обраної теми; визначено мету й основні завдання, об’єкт, предмет та методи дослідження; описано наукову новизну; встановлено практичне значення одержаних результатів; вказано про апробацію результатів дослідження; зазначено структуру й обсяги роботи. На початку роботи розглянуто усиновлення і соціальний захист дітей у категоріальному апараті науки публічного управління; визначено які діти відносяться до дітей-сирот та дітей, позбавлених батьківського піклування як потенційних суб’єктів усиновлення. Основна частина роботи присвячена аналізу організаційно-правових аспектів державного регулювання усиновлення в Україні на сучасному етапі. Безпосередньо охарактеризовано нормативно-правове регулювання процедури усиновлення; розглянуто умови усиновлення та описано порядок його здійснення як пріоритетної форми влаштування дітей-сиріт та дітей, позбавлених батьківського піклування; проаналізовано інституційне забезпечення здійснення усиновлення. Наприкінці роботи окреслено можливості імплементації іноземного досвіду організації і здійснення усиновлення в Україні, а також обґрунтовано необхідність посилення взаємодії громадськості з органами влади у сфері усиновлення як основи захисту прав дітей. У загальному підсумку запропоновано способи удосконалення вітчизняної системи усиновлення як важливої складової соціального захисту дітей. The qualification work is dedicated to the study of the state regulation of adoption as a component of the social protection system for children in Ukraine. The introduction substantiates the relevance and level of elaboration of the chosen topic; the purpose and main tasks, object, subject and research methods are determined; scientific novelty is described; the practical significance of the obtained results is established; the approbation of the research results is indicated; the structure and scope of work are indicated. At the beginning of the work, the adoption and social protection of children in the categorical apparatus of the science of public administration are considered; it is determined which children belong to orphans and children deprived of parental care as potential subjects of adoption. The main part of the work is devoted to the analysis of organizational and legal aspects of state regulation of adoption in Ukraine at the current stage. The regulatory and legal regulation of the adoption procedure is directly characterized; the conditions of adoption are considered and the procedure for its implementation as a priority form of placement of orphans and children deprived of parental care is described; the institutional support for adoption is analyzed. At the end of the work, the possibility of implementing foreign experience in the organization and implementation of adoption in Ukraine is outlined, as well as the need to strengthen the interaction of the public with authorities in the field of adoption as a basis for the protection of children's rights is substantiated. In general, ways to improve the domestic adoption system as an important component of social protection of children are proposed.
