Місцеве самоврядування: європейський досвід розвитку та вітчизняна практика

Abstract

Кваліфікаційну роботу присвячено дослідженню теоретичних засад дослідження місцевого самоврядування: європейського досвіду розвитку та вітчизняної практики. Місцеве самоврядування є стійким інститутом організації місцевої влади, який може виконувати покладені на нього обов'язки перед громадою і нести відповідальність за свої дії. Однак соціально-економічна та політична криза відзначає недоліки у його розвитку, що стосуються сфери виконання повноважень, організації роботи та механізму формування. Це ставлять під сумнів і стимулюють законодавців до комплексного реформування цього інституту. У вступі обґрунтовано актуальність та рівень розробки теми; окреслено мету та основні завдання, об’єкт, предмет та методи дослідження; описано наукову новизну; встановлено практичне значення отриманих результатів магістерської роботи; вказано апробацію результатів дослідження; зазначено структуру та обсяг роботи. На початку роботи розкрита джерельна база та основні поняття і категорії дослідження. Проаналізована законодавча та нормативно-правова база дослідження. Основна частина дослідження присвячена змістовному аналізу європейського досвіду місцевого самоврядування (на прикладі Франції та Польщі). Акцентовано увагу механізмі здійснення, інституційного та правового забезпечення розвитку місцевого самоврядування в Україні. Друга частина роботи присвячена визначеню європейських стандартів інституційного розвитку місцевого самоврядування. Показано актуальні проблеми та основні напрямки організації місцевого самоврядування в Україні на сучасному етапі. Обґрунтовано перспективи оптимізації розвитку місцевого самоврядування в Україні. Розкрито особливості розвитку місцевого самоврядування на прикладі Миколаївської області. The qualification work is devoted to the study of the theoretical foundations of the study of local self-government: the European experience of development and domestic practice. Local self-government is a stable institution of local government organization that can fulfill its duties to the community and bear responsibility for its actions. However, the socio-economic and political crisis points to shortcomings in its development related to the scope of the exercise of powers, the organization of work and the formation mechanism. This is called into question and stimulates legislators to comprehensively reform this institution. The introduction substantiates the relevance and level of development of the topic; the purpose and main tasks, object, subject and research methods are outlined; scientific novelty is described; the practical value of the obtained results of the master's thesis is established; approval of research results is specified; the structure and scope of work are specified. At the beginning of the work, the source base and the main concepts and categories of research are disclosed. The legislative and regulatory framework of the research is analyzed. The main part of the study is devoted to a meaningful analysis of the European experience of local self-government (using the example of France and Poland). Attention is focused on the mechanism of implementation, institutional and legal support for the development of local self-government in Ukraine. The second part of the work is devoted to the definition of European standards of institutional development of local self-government. Actual problems and main directions of the organization of local self-government in Ukraine at the current stage are shown. The prospects for optimizing the development of local self-government in Ukraine are substantiated. The peculiarities of the development of local self-government on the example of the Mykolaiv region are revealed.
