Історія пенітенціарної системи Сполучених Штатів Америки ХХ-ХХІ ст.

Abstract

Актуальність обраної теми кваліфікаційної роботи обґрунтовують ті факти, що у наш час навіть в найрозвиненіших країнах світу спостерігається криза пенітенціарної системи. Проблеми вдосконалення пенітенціарної системи нині турбують майже всі країни цивілізованого світу. У першу чергу це стосується США хоча б тому, що ця країна займає перше місце у світі з кількості ув’язнених осіб на душу населення. Для України реформування пенітенціарної системи має бути засноване на сприйнятті позитивного зарубіжного досвіду її розв’язання, передусім – американського, адже Україна прагне на вступ до світової спільноти демократичних і правових держав, лідером якої є Сполучені Штати Америки. Об’єктом дослідження є американська виправна системи, яка є одним з найважливіших об’єктів державної правової політики. Предметом дослідження є особливості формування пенітенціарної системи Сполучених Штатів Америки ХХ – ХХI ст. Метою даного дослідження є всебічний аналіз історії реформування пенітенціарної системи США з огляду на можливе використання її позитивних досягнень в практиці державного будівництва України. Для досягнення вказаної мети слід поставити наступні дослідницькі завдання: 1) встановити рівень наукового осягнення даної проблеми в американський і вітчизняній науці; 2) проаналізувати систему джерел американського виправного права, яка є основою вдосконалення пенітенціарної політики США; 3) вивчити історію та особливості вдосконалення американської виправної системи, яка є одним з найважливіших об’єктів державної правової політики. The relevance of the chosen topic of the qualification work is substantiated by the facts that nowadays even in the most developed countries of the world there is a crisis of the penitentiary system. The problems of improving the penitentiary system now concern almost all countries of the civilized world. First of all, this applies to the USA, if only because this country ranks first in the world in terms of the number of prisoners per capita. For Ukraine, the reform of the penitentiary system should be based on the perception of positive foreign experience of its solution, first of all - the American one, because Ukraine aspires to join the world community of democratic and legal states, the leader of which is the United States of America. The object of the study is the American correctional system, which is one of the most important objects of state legal policy. The subject of the study is the peculiarities of the formation of the penitentiary system of the United States of America in the 20th - 21st centuries. The purpose of this study is a comprehensive analysis of the history of reforming the US penitentiary system with a view to the possible use of its positive achievements in the practice of state building in Ukraine. To achieve this goal, the following research tasks should be set: 1) establish the level of scientific understanding of this problem in American and domestic science; 2) to analyze the system of sources of American correctional law, which is the basis for improving the US penitentiary policy; 3) to study the history and peculiarities of the improvement of the American correctional system, which is one of the most important objects of state legal policy.
