Інститут Президента України в системі публічної влади і управління

Abstract

Кваліфікаційна робота присвячена комплексному дослідженню інституту Президента України як ключового елементу системи публічної влади та управління. У роботі проаналізовано еволюцію президентської інституції від моменту її запровадження до сучасного етапу, з урахуванням політичних трансформацій, конституційних змін та європейських демократичних практик. Визначено особливості правового статусу Президента, його функції, повноваження та місце у механізмі поділу влади. У другому розділі розкрито взаємодію Президента України з органами державної влади — законодавчою, виконавчою та судовою гілками. Проаналізовано механізми впливу Президента на формування уряду, нормотворчість, кадрову політику, діяльність правоохоронних та судових органів. Особливу увагу приділено практиці зупинення актів Кабінету Міністрів, реалізації права вето, ролі Президента як гаранта конституційності та стабільності державної влади. Третій розділ зосереджено на сучасних тенденціях розвитку інституту президентства в умовах європейської інтеграції України. Визначено перспективи вдосконалення конституційно-правового статусу Президента, необхідність підвищення прозорості та підзвітності президентської влади, а також адаптацію української моделі до стандартів ЄС. Запропоновано рекомендації щодо оптимізації функціонування інституту Президента, удосконалення законодавчого регулювання та зміцнення системи стримувань і противаг. Практичне значення роботи полягає у можливості використання її результатів у науковій, освітній та управлінській діяльності, а також у подальшій розробці реформ публічного управління та конституційного будівництва. Наукова новизна полягає в системному аналізі сучасного статусу Президента в умовах політико-правових викликів, включно з періодом воєнного стану та активної євроінтеграції. The master’s thesis is devoted to a comprehensive study of the Institute of the President of Ukraine as a key element of the system of public authority and governance. The research analyzes the evolution of the presidential institution from its establishment to the present stage, taking into account political transformations, constitutional changes, and European democratic practices. The work identifies the features of the President’s legal status, his functions, powers, and place within the mechanism of separation of powers. The second chapter examines the interaction of the President of Ukraine with state authorities — the legislative, executive, and judicial branches. It analyzes the mechanisms of presidential influence on government formation, rulemaking, personnel policy, and the activities of law enforcement and judicial bodies. Particular attention is paid to the practice of suspending acts of the Cabinet of Ministers, the application of the veto power, and the role of the President as a guarantor of constitutionality and stability of state power. The third chapter focuses on current trends in the development of the presidential institution in the context of Ukraine’s European integration. The research outlines prospects for improving the constitutional and legal status of the President, enhancing transparency and accountability of presidential authority, and adapting the Ukrainian model to EU standards. The work proposes recommendations for optimizing the functioning of the presidential institution, improving legislative regulation, and strengthening the system of checks and balances. The practical significance of the thesis lies in the potential application of its results in scientific, educational, and administrative activities, as well as in further development of public administration reforms and constitutional development. The scientific novelty is reflected in the systematic analysis of the modern status of the President under political and legal challenges, including the period of martial law and active European integration.
